The Attorney-General and Minister of Justice, Dr. Dominic Ayine, has abandoned the case against Finance Minister Dr. Cassiel Ato Forson and businessman Richard Jakpa.

This comes after the Court of Appeal acquitted and discharged Dr. Ato Forson and Mr Jakpa, overturning a previous order from the High Court.

However, in a notice filed on Thursday, August 8, 2024, the former Attorney General, Godfred Yeboah Dame, asked the Supreme Court to set aside the decision by the Court of Appeal and order Dr. Forson and Jakpa to continue to stand trial at the High Court.

However, a notice issued by the Attorney-General’s chambers on Thursday, January 23, 2025, said that the state had decided not to pursue the matter any further.

“PLEASE TAKE NOTICE that the Republic, having previously served notice of appeal to appeal to the Court against the judgment delivered by the Court of Appeal on the 30th day of July 2024 hereby give(s) you NOTICE that the Republic does not intend further to prosecute the appeal, but that the Republic abandons all further proceedings with respect to this matter as from the date of this notice”.

The duo, Dr Ato Forson and Mr Jakpa, who were dragged before the Accra High Court for causing the state a €2.3 million loss in an ambulance trial, were set free by the Court of Appeal.

Appealing the ruling, the then A-G held that the Court of Appeal misdirected itself when it said that the prosecution failed to establish a prima facie case against the two accused persons.

The Attorney-General, therefore, wanted the apex court to overturn the acquittal and discharge and to order the accused persons to continue with their defence.

Below is the Attorney-General’s notice.
